  1. General information

Welcome to the PoceniPC.com online store. Our goal is to provide a safe, transparent and pleasant purchase experience for refurbished computer equipment. The general terms and conditions presented below clearly define the rights and obligations of the consumer and the seller and apply to all purchases in our store.

These terms are prepared in accordance with the laws of the Republic of Slovenia and European directives, in particular:

  • Consumer Protection Act (ZVPot-1),
  • Electronic Commerce Market Act (ZEPT),
  • Electronic Communications Act (ZEKom-2),
  • Obligations Code (OZ),
  • Act on Alternative Dispute Resolution for Consumer Disputes (ZIsRPS),
  • GDPR and ZVOP-2,
  • and Directive (EU) 2011/83 on consumer rights and Directive (EU) 2019/771 on the sale of goods.

This ensures that our terms are transparent, fair and beneficial to both parties. 

 

  1. Pre-contractual information

The online store clearly states: the main characteristics of the product, the total price including VAT, possible additional costs (e.g. delivery), available payment and delivery methods, the estimated delivery time, the right of withdrawal, information on liability for conformity and commercial warranty (if provided), and for goods with digital elements also information on functionality, compatibility and interoperability.   1. Purchase process
  • The consumer may register on the website or make a one-time purchase as a guest.
  • Before submitting the order, all entries can be reviewed and errors corrected (quantity, addresses, payment method, delivery).
  • Upon placing the order, the contract is concluded and the consumer receives an electronic order confirmation and the Terms and Conditions on a durable medium (e-mail).
  • The order enters processing.
  • The consumer is informed about the shipment of the goods with an additional message (e.g. “Order shipped”).

 

  1. Prices, discounts and “lowest price in the last 30 days”

All prices are in EUR and include VAT. With every discount we also display the lowest price in the last 30 days before the discount (in the case of gradual discounts, the lowest price before the first discount is taken into account). If an item has been on sale for less than 30 days, the lowest price since the start of the sale is displayed. Prices are not adjusted based on automated decision-making or customer profiling.   1. Payment methods

Supported: bank transfer; cash upon personal pickup; cash on delivery; payment by payment cards; payment via electronic payment provider (e.g. PayPal); installment payment through a bank or service provider; installment payment via Leanpay. For more information visit the page »Payment«.

 

  1. Delivery and delivery times

Delivery is carried out by contractual partners (e.g. Pošta Slovenije). The estimated delivery date is displayed next to the product price. The usual delivery time for items in stock is 1–3 working days. The date is informative and does not take into account extraordinary circumstances. Unless otherwise agreed, the goods will be delivered no later than 30 days after the conclusion of the contract. For more information visit the page »Delivery«.

 

  1. Right of withdrawal (14 days)

The consumer may withdraw from the contract within 14 days of receiving the goods without giving any reason. Withdrawal may be communicated in several ways:

The purchase price will be refunded no later than 14 days after receiving the withdrawal notice; the refund may be withheld until the goods are received or proof of shipment is provided. In case of withdrawal, the consumer bears the direct cost of returning the goods unless the seller voluntarily covers it. Returns are not conditioned by the original packaging. The consumer is responsible for any diminished value of the goods if the reduction results from handling other than what is necessary to determine the nature, characteristics and functioning of the goods. In such case, after refunding the purchase price we may subsequently request compensation for the reduced value of the goods and inform the consumer accordingly. The right of withdrawal does not apply in cases listed in Article 135 of ZVPot-1 (e.g. digital content after activation has begun, custom-made goods).   1. Liability for conformity and warranty

The seller is liable for any lack of conformity that appears within two years of delivery. For used/refurbished goods a shorter liability period may be expressly agreed (not shorter than one (1) year). If a lack of conformity appears within one year from delivery, it is presumed to have existed at the time of delivery unless the seller proves otherwise. Order of claims: first repair or replacement; if this is not possible or not carried out within a reasonable time, a price reduction or withdrawal follows. If the lack of conformity appears within less than 30 days from delivery, the consumer may immediately withdraw from the contract and request a refund without first requesting repair, replacement or price reduction.   1. Complaints and service (RMA)

Report non-conformity or malfunction via the request for return or repair of the product. Protect the device and include a description of the issue. We recommend making a data backup.   1. Alternative dispute resolution (ADR)

We attempt to resolve disputes amicably. Consumers have the possibility of alternative dispute resolution through registered ADR providers in Slovenia. The seller currently does not recognize any ADR provider as competent. This does not affect your right to judicial protection.

 

  1. Business purchases (B2B)

For customers who are not consumers under ZVPot-1 (e.g. companies, sole traders), the 14-day right of withdrawal does not apply. For business purchases, issues of defects are assessed under the Obligations Code (material defects), and warranties and any additional guarantee conditions apply as expressly agreed in the contract, invoice or warranty document.

 

  1. Data protection

Personal data are processed only for the purpose of order execution, delivery, service and accounting, and with your consent also for newsletters and cookies. Personal data may be shared with contractual processors (e.g. delivery services, payment providers, accounting), but only to the extent necessary for order execution, delivery, payment or repair. These partners are obliged to protect the data and may use them exclusively for performing the agreed services. Data, including the contract text, are stored in accordance with the law and deleted after service completion.   1. Final provisions

The contract may be concluded in the Slovenian language. The seller reserves the right to change these terms; the terms published at the time of placing the order apply. For consumers, mandatory rules on territorial jurisdiction based on their place of residence apply in disputes. In the case of B2B customers, disputes shall fall under the jurisdiction of the court in Nova Gorica.
